Terms of Service

By creating an account or using the Pivot platform and services (the "Services"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference.

If you are using the Services on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. If you do not agree to these Terms, do not use the Services.

Pivot Inc. ("Pivot," "we," "our," or "us") reserves the right to update these Terms at any time. Continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.

Pivot is a property management platform designed for mid-term rental investors. The Services include, but are not limited to:

A unified dashboard for managing leads, bookings, and revenue across multiple rental properties

Calendar synchronization with third-party booking platforms (Airbnb, VRBO, Inago, Booking.com)

Revenue analytics and reporting tools

Lead capture and CRM functionality

A Done-For-You (DFY) marketing website for your rental business (available on select plans)

The Services are provided on a subscription basis. Features available to you depend on your selected subscription plan.

To use the Services, you must create an account and provide accurate, complete, and current information. You are responsible for:

Maintaining the confidentiality of your account credentials

All activity that occurs under your account

Notifying us immediately at support@pivotapp.com if you suspect unauthorized access

You may not share your account with others or create accounts for the purpose of circumventing usage limits. Pivot reserves the right to suspend or terminate accounts that violate these Terms.

Plans and Billing. Pivot offers subscription plans billed monthly or annually. Prices are displayed on our Pricing page and are subject to change with 30 days' notice.

Free Trial. New accounts may be eligible for a 14-day free trial. No credit card is required to start a trial. At the end of the trial period, you must subscribe to a paid plan to continue using the Services.

Payment Processing. Payments are processed by Stripe. By providing payment information, you authorize Pivot to charge your payment method on a recurring basis for your selected plan.

Cancellation. You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for unused time.

Refunds. Refund requests within the first 7 days of a paid subscription will be honored in full. After 7 days, refunds are issued at our discretion on a case-by-case basis. Contact billing@pivotapp.com.

You agree to use the Services only for lawful purposes and in compliance with these Terms. You agree not to:

Use the Services to violate any applicable law, regulation, or third-party rights

Attempt to gain unauthorized access to any part of the Services or our infrastructure

Upload or transmit malware, spam, or any harmful code

Misrepresent your identity or affiliation

Scrape, crawl, or extract data from the Services in an automated manner without our written permission

Use the Services to engage in discriminatory practices prohibited under fair housing or anti-discrimination laws

Resell or sublicense access to the Services without our written consent

Violation of this section may result in immediate account suspension or termination without refund.

The Services integrate with third-party booking platforms including Airbnb, VRBO, Inago, and Booking.com. Your use of these integrations is subject to the respective terms of service and privacy policies of those platforms.

Pivot is not responsible for the availability, accuracy, or actions of third-party platforms. If a third-party platform changes or discontinues its API, certain Pivot features may be affected. We will make commercially reasonable efforts to maintain integrations but cannot guarantee uninterrupted sync.

By connecting a third-party account, you grant Pivot permission to read and write data to that account on your behalf as described in our Privacy Policy.

You retain full ownership of all data, property listings, photos, and content you upload to Pivot ("Your Content"). By uploading Your Content, you grant Pivot a limited, non-exclusive, royalty-free license to use, store, display, and transmit Your Content solely to provide the Services.

You are solely responsible for ensuring that Your Content does not infringe any third-party intellectual property rights and complies with applicable laws. Pivot does not claim ownership of Your Content and will not use it for advertising purposes without your consent.

The Pivot platform, including its design, software, trademarks, logos, and all content created by Pivot, is the exclusive property of Pivot Inc. and is protected by copyright, trademark, and other intellectual property laws.

Nothing in these Terms grants you any right to use Pivot's trademarks, logos, or brand assets without our prior written consent.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Pivot does not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components. You use the Services at your own risk.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PIVOT INC. AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO PIVOT IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED DOLLARS ($100).

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so the above limitations may not apply to you.

You agree to indemnify, defend, and hold harmless Pivot Inc. and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

Your use of the Services

Your violation of these Terms

Your violation of any third-party rights, including intellectual property rights

Your Content

Either party may terminate this agreement at any time. You may terminate by cancelling your subscription and deleting your account. We may terminate or suspend your account immediately if you breach these Terms or if we are required to do so by law.

Upon termination, your right to use the Services ceases immediately. Sections 7, 8, 9, 10, 11, and 13 of these Terms survive termination.

These Terms are governed by the laws of the State of Arizona, USA, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the Services that cannot be resolved through good-faith negotiation will be submitted to binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, conducted in Maricopa County, Arizona.

You waive any right to participate in a class action lawsuit or class-wide arbitration against Pivot.
